Terms of Service

Effective date: August 16, 2026 · Last updated: August 16, 2026

The short version

  • BrushHouseCRM is free, invitation-only early access for United States businesses.
  • Your business keeps ownership of the customer and job information it puts into the service.
  • You are responsible for your customer relationships, your messages, your contracts, and the accuracy of what you create or record with BrushHouseCRM.
  • Early-access software can change and sometimes fail. Keep copies of records your business cannot afford to lose, and review AI-generated material before using it.
  • These terms limit our warranties and liability. Questions or copyright reports: email[email protected].

Who these terms are for

These Terms of Service are an agreement between you and Jake Taubner. BrushHouseCRM is operated by Jake Taubner, a New Jersey sole proprietor. They apply when you create an account, accept an invitation, sign in to, or otherwise use the BrushHouseCRM application. “BrushHouseCRM,” “we,” “us,” and “our” refer to the service and its operator.

BrushHouseCRM is offered only for business use in the United States. You must be 18 or older. If you use the service for a company, sole proprietorship, partnership, or other organization, you represent that you have authority to accept these terms for it. In these terms, “you” includes that business and each person it authorizes to use its workspace. If you do not have that authority, do not use the service for the business.

These terms do not make your customers BrushHouseCRM account users merely because they open a public proposal, invoice, payment request, or other document link. The agreement shown in one of those documents is between the contractor and its customer. BrushHouseCRM is not a party to it.

Free early access

BrushHouseCRM is currently free and available only to businesses we invite or approve. This is an early-access service: features may be incomplete, may contain errors, and may be added, changed, or removed as we learn what works. We do not promise a particular feature set, support response time, storage allowance, or service level.

We may offer paid plans later. We will present the price, billing schedule, cancellation terms, and any other payment terms for you to review and affirmatively accept before we charge you. We will not automatically turn free early access into a paid subscription.

Your account and workspace

Give us accurate account information and keep it current. Protect the email account, sign-in provider, devices, and one-time codes used to access BrushHouseCRM. Do not share a personal sign-in or let someone use your identity. Tell us promptly if you believe an account, invitation, API key, public document link, or connected service has been compromised.

A workspace owner or administrator controls invitations, roles, permissions, and removal of team members. The business is responsible for deciding who should have access and for what its authorized users do in the workspace. If workspace control is disputed, we may pause changes while we request reasonable documentation and may rely on the account and membership records already in the service.

Public proposal and invoice links work like bearer links: anyone who receives the complete link may be able to open the document and take the actions it offers. Share those links only with intended recipients, and contact us if one needs to be disabled.

Your content and customer data

“Your Content” means the contacts, customer details, projects, photos, notes, schedules, checklists, messages, proposal and invoice material, branding, files, and other information that you or your authorized users put into BrushHouseCRM. As between you and us, you keep ownership of Your Content. These terms do not transfer it to us.

You give us a limited, non-exclusive license to host, copy, process, transmit, display, and back up Your Content only as reasonably needed to provide, secure, troubleshoot, and support the service, follow your directions, enforce these terms, and comply with law. That license ends when the content is deleted from our active systems, except for temporary backup copies and records we must retain by law. OurPrivacy Policyexplains the details.

You represent that you have the rights and permissions needed to collect, upload, use, and share Your Content through BrushHouseCRM. You are responsible for giving customers and workers any privacy notices required for your business and for responding to their requests. Do not upload material that violates another person’s privacy, publicity, confidentiality, or intellectual-property rights.

BrushHouseCRM is not your only records archive. Keep independent copies of signed contracts, tax and accounting records, legally required notices, and anything else your business cannot afford to lose. You may request a copy of information not otherwise available in the app by emailing us, and we will make reasonable efforts to help.

AI-assisted features

Some optional tools use Anthropic to draft descriptions or extract suggested checklist answers from information you choose to submit. Using one of these tools directs us to send the relevant prompt and context to Anthropic as described in the Privacy Policy. Make sure you have permission to submit that information, and avoid including information the tool does not need.

AI output can be false, incomplete, outdated, biased, or unsuitable for the job. Similar output may be provided to other users. Always review and edit output before using or sharing it, especially where it affects scope, price, safety, warranties, legal obligations, or a customer’s decision. An AI suggestion is not professional advice and does not replace your judgment.

As between you and BrushHouseCRM, you may use output generated for you. To the extent we obtain any rights in that output, we assign those rights to you. We cannot promise that an output is eligible for copyright protection or that it will not resemble material created for someone else.

Customer communications

BrushHouseCRM can send email and text messages using the recipients and content you provide. You are the sender of those business communications and are responsible for following the Telephone Consumer Protection Act, CAN-SPAM Act, state laws, carrier rules, and any other requirements that apply to your messages.

  • Contact only people with whom you have a lawful basis to communicate. Do not use purchased or rented contact lists, scraped addresses, or randomly generated numbers.
  • Send promotional or marketing messages only after obtaining the legally required consent, including written consent when the law requires it. Keep your own evidence of that consent.
  • Identify your business honestly, do not mislead recipients about why you are contacting them, and honor opt-out and do-not-contact requests promptly across every channel you control.
  • Do not send harassment, threats, scams, unlawful discrimination, or content that infringes another person’s rights.

Product features such as opt-out text, preferences, templates, or delivery statuses are conveniences, not a guarantee of legal compliance or delivery. You remain responsible even if a feature fails, a carrier blocks a message, or a recipient asks to stop in a way the service does not detect.

Proposals, invoices, and electronic signatures

BrushHouseCRM provides tools for preparing and sharing proposals, estimates, change orders, work orders, invoices, payment requests, acknowledgements, and signatures. You choose the wording, prices, taxes, dates, recipients, and terms in those documents. You are responsible for checking all of them before sending and for meeting licensing, home-improvement contract, cancellation, disclosure, retention, tax, and other rules that apply to your work.

BrushHouseCRM does not provide legal, tax, accounting, construction, or insurance advice and does not guarantee that an electronic signature, acceptance flow, acknowledgement, or document creates an enforceable agreement. You are responsible for confirming the signer’s identity and authority, collecting any legally required electronic-record consent, and giving the customer copies they are entitled to receive.

BrushHouseCRM is not a payment processor. Payment requests and ledger entries record information that you enter; the service does not hold funds, settle transactions, verify that money changed hands, or replace your bank and accounting records. Reconcile every payment and resolve refunds, chargebacks, taxes, and customer disputes directly with the appropriate customer and financial provider.

Acceptable use

You may not use BrushHouseCRM to:

  • break the law, violate these terms, or help someone else do so;
  • impersonate another person or business, falsify records, or misrepresent your authority;
  • upload malware, probe or bypass security, access another workspace, interfere with the service, or overload it with automated traffic;
  • copy, scrape, resell, sublicense, reverse engineer, or build a competing service from non-public parts of BrushHouseCRM, except where applicable law does not allow that restriction;
  • use another person’s content or personal information without the required rights; or
  • use the service for emergency dispatch, life-safety, or another use where a delay or error could cause serious harm.

BrushHouseCRM is not designed to store payment-card numbers, bank-account credentials, Social Security numbers, government-identification numbers, medical or health records, authentication secrets, or similarly regulated or highly sensitive information. Do not put that information into the service unless we first agree in a separate writing that specifically covers it.

We may investigate suspected misuse and review relevant content when reasonably necessary to protect users, the service, or the public; respond to a complaint; or comply with law. We do not undertake a general duty to monitor everything users enter.

Third-party services

BrushHouseCRM relies on service providers and can connect to services such as Google, Apple, Google Drive, Dropbox, PaintScout, and browser speech recognition. Your use of a connected service is also governed by that provider’s terms and privacy practices. You are responsible for the accounts, permissions, credentials, and data you choose to connect or transfer.

We do not control third-party services and are not responsible for their content, security, availability, changes, or charges. An integration may stop working if its provider changes or withdraws access. We may replace a service provider or discontinue an integration while keeping our own Privacy Policy accurate.

Ownership and feedback

Except for Your Content, BrushHouseCRM and its software, design, documentation, branding, and other materials belong to us or our licensors. These terms give you a limited, revocable, non-transferable right to use the service for your internal business operations during early access. They do not give you ownership of the service or permission to use our name or branding as your own.

If you send ideas or feedback, you allow us to use them without restriction, payment, or obligation to you. This permission is perpetual, worldwide, transferable, sublicensable, and royalty-free, but it does not give us ownership of unrelated customer or job information included in Your Content.

If you believe material stored through BrushHouseCRM infringes your copyright, email[email protected]with your contact information, identification of the work and material, where the material appears, why you believe the use is unauthorized, and a statement that your report is accurate. We may remove or disable reported material and may suspend repeat infringers. This is a practical complaint process, not a representation that we have registered a formal designated agent.

Suspension, termination, and your data

You may stop using BrushHouseCRM at any time. To request account deletion, email us. Data deletion is handled as described in the Privacy Policy, including the time needed to remove active data and rotate backups. Save anything you need before requesting deletion.

We may restrict or suspend access immediately when reasonably necessary to address a security risk, unlawful activity, harm to another person, a provider requirement, nonpayment under any future paid agreement, or a serious or repeated violation of these terms. When the situation allows, we will try to explain the issue and give you a reasonable opportunity to correct it before permanently ending access.

If we decide to discontinue the entire service for reasons unrelated to your conduct, we will make reasonable efforts to give active workspace owners at least 30 days’ notice and a reasonable opportunity to retrieve their data before shutdown. Emergencies, legal orders, provider failures, or security threats may make that notice or access impossible.

Provisions that by their nature should continue after access ends will survive, including ownership, disclaimers, limits on liability, responsibility for claims, and general terms.

Disclaimers

To the fullest extent permitted by law, BrushHouseCRM is provided “as is” and “as available.” We disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from a course of dealing or usage of trade.

We do not promise that the service will be uninterrupted, timely, secure, error-free, or compatible with every device; that stored information will never be lost or altered; that messages will be delivered; or that calculations, reports, translations, AI output, signatures, and third-party integrations will be accurate or available. You are responsible for deciding whether the service and its results are suitable for your business.

Some laws do not allow certain warranty exclusions. Any rights that cannot lawfully be excluded still apply to you.

Limits on liability

To the fullest extent permitted by law, Jake Taubner and BrushHouseCRM will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, business opportunities, goodwill, or data, arising out of or related to the service or these terms, even if we were told such damages were possible.

Our total aggregate liability for all claims arising out of or related to the service or these terms will not exceed the greater of $100 or the fees you paid to us for BrushHouseCRM during the 12 months before the event giving rise to the claim. This limit applies across all legal theories and all related events together, not separately to each claim or user.

These exclusions and limits do not apply where applicable law prohibits them or to liability that cannot legally be limited. They are an important part of the arrangement under which we can provide a free early-access service.

Your responsibility for claims

You will defend, indemnify, and hold harmless Jake Taubner and BrushHouseCRM from third-party claims, losses, liabilities, damages, judgments, and reasonable legal costs arising from: Your Content or an allegation that it violates another person’s rights; your customer communications; your proposals, invoices, services, payments, or customer agreements; your violation of law or these terms; or misuse by you or your authorized users.

We will promptly tell you about a covered claim and reasonably cooperate at your expense. You may control its defense with qualified counsel, but may not settle in a way that admits wrongdoing by us, imposes an obligation on us, or fails to release us without our written consent. You do not have to cover a claim to the extent it was caused by our gross negligence or intentional misconduct.

New Jersey law

New Jersey law governs these terms and any claim arising from them or the service, without regard to conflict-of-law rules. This choice does not take away any protection that applicable law says cannot be waived by agreement.

Changes to these terms

We may update these terms as the service changes. We will post the revised terms here and update the “Last updated” date. Unless the revised terms say otherwise, they take effect when posted. Continuing to use BrushHouseCRM after that date means you accept the revised terms. If you disagree, stop using the service and request deletion of your account.

A posted update will not by itself enroll you in a paid plan. As explained above, we will ask you to affirmatively accept the applicable price and billing terms before we charge you.

General terms

These terms, the Privacy Policy, and any separate written early-access agreement between you and us are the entire agreement about your use of BrushHouseCRM. If a signed separate agreement conflicts with these terms, the separate agreement controls for that conflict. A purchase order or other form you issue does not change the agreement unless we expressly sign it.

You may not assign these terms or transfer your account without our written consent. We may assign these terms as part of a sale, reorganization, or transfer of the service. Neither party is responsible for delay caused by events beyond its reasonable control, although this does not excuse obligations that can still be performed.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. Headings are only for convenience. These terms do not create a partnership, joint venture, employment, agency, or franchise relationship, and they do not give rights to anyone other than you and us.
